These Terms of Service ("Terms") are a binding agreement between you and Nestling Studios LLC ("Nestling Studios," "we," "us," or "our") governing your use of the game Pocket Flock and related services (the "Game"). By downloading or playing the Game, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Game.
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to play. If you are a minor in your jurisdiction, you confirm a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and play the Game for your own non-commercial entertainment. We and our licensors own all rights in the Game, including its code, art, characters, and trademarks. You receive no ownership rights.
If the Game offers an optional account or sign-in, you are responsible for activity under it and for keeping your credentials secure. We may suspend or terminate accounts that violate these Terms.
The Game includes virtual currency (such as Coins and bux) and virtual items (such as chickens and decorations) (collectively, "Virtual Items").
In-app purchases are sold and processed by Google (Google Play) or Apple (App Store) under their terms, not by us. Your purchases are billed to your store account. Refund requests are handled by Google or Apple under their respective policies; please contact the relevant store. Any subscription products (if offered) renew automatically until cancelled in your store account, and their specific terms are disclosed at the point of purchase.
The Game is free and supported in part by advertising, which may include optional rewarded ads and occasional interstitial ads. Your ad and tracking choices are described in our Privacy Policy. A one-time "Remove Ads" purchase disables interstitial ads.
You agree not to: cheat, exploit bugs, or use unauthorized third-party software, bots, or modifications; reverse engineer, decompile, or tamper with the Game except where such restriction is prohibited by law; access the Game through unauthorized means or disrupt its servers; buy, sell, or trade accounts or Virtual Items for real money outside the Game; or use the Game for any unlawful purpose. We may take action, including suspension or termination, against violations.
If the Game lets you submit content or interact with other players (such as gifting, naming, visiting, or trading), you are responsible for your conduct and content, you must not submit unlawful, infringing, or abusive material, and you grant us a worldwide, royalty-free license to host and use that content to operate the Game. We may moderate, remove, or restrict content and features at our discretion.
We may update, modify, suspend, or discontinue the Game or any feature (including Virtual Items and online services) at any time, with or without notice. We are not liable to you for doing so, except as required by law.
The Game is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Game will be uninterrupted, secure, or error-free.
To the fullest extent permitted by law, Nestling Studios and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or Virtual Items. Our total liability for any claim relating to the Game will not exceed the greater of (a) the amount you paid us in the six (6) months before the claim or (b) USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless Nestling Studios from claims and expenses arising out of your misuse of the Game or violation of these Terms, to the extent permitted by law.
You may stop using the Game at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Game. Sections that by their nature should survive (including 4, 10, 11, 12, and 14) survive termination.
These Terms are governed by the laws of the State of Indiana, United States, without regard to conflict-of-laws rules. You and Nestling Studios agree to first attempt to resolve any dispute informally by contacting us. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Indiana, and you consent to their jurisdiction. Nothing here deprives you of mandatory consumer protections in your country of residence.
We may update these Terms. We will post the updated version with a new effective date and, for material changes, provide a more prominent in-Game notice. Continued play after changes take effect means you accept the updated Terms.

Apple-specific note: Apple is not a party to these Terms and is not responsible for the Game; the standard Apple "Licensed Application End User License Agreement" additional terms also apply to App Store downloads.
